E-Lock instaTDS is a simple, easy-to-use software that helps organizations to issue digitally signed Form 16s to their employees at just a click of mouse. In addition, instaTDS permits you to distribute the forms using your e-mail system eliminating the hassles of printing & distribution. instaTDS allows organizations to digitally sign using digital certificates issued by any CA in India. The digital certificates can be stored either on e-Tokens or installed in IE.

What the law says

The Indian Information Technology Act 2000 recognizes the use of Digital Signatures as equivalent to Physical Signatures. Therefore, a digitally signed Form 16 has the same legal validity as a physically signed one.

	In addition to this, as per Circular No. 2/2007 dated 21/5/2007 from the Income Tax Dept, "The Central Board of Direct Taxes have, therefore, in exercise of powers under section 119 of the Income-tax Act, 1961, decided for the proper administration of this Act to allow the deductors, at their option, in respect of the tax to be deducted at source from income chargeable under the head "Salaries" to use their digital signatures to authenticate the certificates of deduction of tax at source in Form 16…"
	Further, Tax deductees are no longer required to file a copy of their form 16/ Form 16A along with their returns to the Income Tax Dept. Hence the need for a paper-based Form 16/16A is eliminated.
